Jim Whaley Tires ("Jim Whaley Tires," "we," "us," or "our") explains in this Privacy Policy how we collect, use, disclose, and retain personal information and how you can exercise choices about that information. Personal information means information that identifies, relates to, or can reasonably be linked to an individual or household under applicable law.
1 Scope of this policy
This Policy applies to jimwhaleytires.com and other online pages that link to it, requests for appointments and estimates, our customer communications, and customer information we handle in connection with our stores, advertising, and tire and automotive services (collectively, the "Services"). It applies to our handling of information received through Google, Meta, other advertising platforms, email, text messages, telephone communications, and social media.
A separate notice may apply to employment applications, employee information, a financing application, or a particular program. Where a separate notice applies, it supplements this Policy and controls for that particular activity if the notices conflict. Independent lenders, payment services, social networks, and other third parties have their own privacy practices. This Policy does not authorize marketing communications, recordings, or tracking that require a separate consent.
2 Personal information we collect
The information involved depends on your interaction with us. We collect information you provide, information generated by your use of the Services, and information supplied by service providers or other sources described below. The categories and examples are:
- Contact information and identifiers. Name, mailing address, email address, telephone number, customer or transaction identifier, IP address, browser or device identifiers, and the store you select. We use these details to identify customers, respond to requests, provide services, and administer permitted communications.
- Vehicle and commercial information. Vehicle year, make, model, trim, tire size, and, when supplied or needed for service, VIN, license plate, mileage, inspection information, service history, photographs, estimates, appointments, purchases, returns, warranty claims, and offers of interest. We use this information for service, fitment, records, warranty administration, and relevant customer communications.
- Payment and transaction information. Billing details, payment method, transaction amount, payment status, and related receipts. Payment processors may handle card or financial information necessary to process a transaction. Information you submit directly to an independent financing provider is governed by that provider's notice; we may receive limited application status or transaction information needed to complete your purchase.
- Communications and preferences. Inquiries, emails, texts, survey responses, reviews, attachments, communication preferences, and records of consent and withdrawal. We use this information to respond, provide customer support, and maintain communication preferences. Any additional recording or monitoring that requires notice or consent is subject to those requirements at the relevant interaction.
- Device and online activity information. Browser and operating system, referring pages or campaigns, pages and products viewed, clicks, interactions with forms, time and date of visits, advertising interactions, and email delivery, opening, or link-click activity. We request permission before collecting precise device location where such a feature is offered and consent is required. We do not use sensitive personal information to infer personal characteristics for advertising.
Do not submit Social Security numbers, financial account credentials, full payment card details, health information, or other unnecessary sensitive information through ordinary contact forms, email, texts, or public reviews. Use the designated secure payment or financing process when financial information is required. We limit sensitive information to what is reasonably needed for the requested service, security, legal compliance, or another purpose permitted by law.
3 Sources of information
We obtain information directly from you, including through stores, forms, phone calls, email, texts, or social interactions; automatically through your device and use of our Services; and from providers that help us operate appointments, payments, customer support, advertising, and communications. We may also receive information from a person you authorize, a fleet or warranty program in which you participate, a manufacturer handling registration or a recall, or a public review or social media platform. We may combine information about the same customer from these sources for the purposes described in this Policy, subject to applicable law and your choices.
4 How we use information
- Provide requested services, estimates, appointments, tire fitment assistance, inspections, purchases, payments, receipts, customer support, and follow-up about work you have authorized.
- Maintain service and transaction records; administer warranties, returns, rebates, registrations, fleet arrangements, safety communications, and recalls; and resolve disputes.
- Send permitted promotions and other marketing through email, SMS or MMS, Google, Meta, paid search, paid social, display, video, direct mail, and other channels we use consistent with applicable notice and consent requirements.
- Measure campaign results, attribute inquiries or purchases to advertising, build permitted audiences, personalize content and offers, and understand how customers use our Services.
- Operate and improve our website and customer experience; troubleshoot errors; maintain security; detect misuse or fraud; and protect customers, staff, property, and legal rights.
- Maintain consent and suppression records, respond to privacy requests, comply with legal requirements, and support accounting, audits, insurance, and business administration.
We do not treat this list as permission to use information for every future purpose. Before using personal information for a materially different purpose, we provide additional notice and obtain consent when required. Where we create deidentified information, we maintain it in deidentified form and do not attempt to reidentify it except as permitted by law.
5 How we disclose information
Operational service providers. We disclose information reasonably needed by vendors that provide hosting, security, scheduling, customer management, payment processing, communications, analytics, professional advice, and marketing services on our behalf. Their permitted handling of information is subject to applicable contractual and legal restrictions. A vendor's independent advertising activities, if any, are addressed separately below. We use ClickSend and Auto CRM to support our active text messaging programs.
Advertising and analytics partners. Subject to applicable consent requirements and privacy choices, our analytics and advertising tools disclose online identifiers, device and internet activity, general location, and related interaction data to partners that help measure advertising and display relevant ads. These partners may combine this information with information collected elsewhere and may act as independent businesses for some purposes. This Website tracking is distinct from sharing customer lists: we do not provide customer lists to third parties or affiliated brands for their own marketing.
Service-related partners and affiliates. We disclose relevant contact, vehicle, transaction, and claim information to manufacturers, warranty administrators, fleet programs, lenders or payment providers you choose, and affiliated businesses involved in administering the Services, when necessary for the transaction or otherwise permitted by law. A shared brand or ownership relationship does not by itself authorize another company to send you marketing texts.
Legal, safety, and business transactions. We may disclose relevant information when reasonably necessary to comply with law or valid legal process, protect rights or safety, investigate fraud, or establish or defend legal claims. We may also disclose information in connection with a proposed or completed merger, acquisition, financing, reorganization, or asset transfer, subject to applicable law and appropriate protections. A transfer does not eliminate applicable consent or privacy obligations.
At your direction and in public areas. We disclose information when you direct or authorize us to do so. Reviews or other content you choose to post publicly can be seen by others. Please avoid including private information about yourself or anyone else in public submissions.
Text messaging exception. We do not sell, rent, or disclose mobile numbers collected solely for text-message enrollment, SMS opt-in data, or SMS consent records to third parties or affiliates for their own marketing or promotional purposes. We may disclose this information to providers solely to deliver, administer, secure, and support our messaging program, and as legally required. These records are excluded from advertising audience uploads. This specific restriction controls over any broader disclosure language in this Policy.
6 Cookies and advertising technologies
Cookies are small files stored on a browser or device. Pixels, tags, software interfaces, and similar tools can transmit information about an interaction. Some technologies support necessary functions such as security, form operation, and remembering choices. Others support preferences, analytics, advertising, and campaign measurement. Session cookies generally expire when a session ends; persistent technologies can remain until they expire or are deleted.
We use Google and Meta advertising and may use other advertising providers. Third-party vendors, including Google, can show our ads across other websites and services and use cookies or device identifiers to select ads based on previous visits to our website or interactions with us. Meta services include Facebook and Instagram. Advertising tools may associate a visit, inquiry, or transaction with a campaign and with a platform account or device, subject to your choices and applicable requirements.
We use analytics tools and Meta Pixel to understand Website activity and measure advertising performance. These tools may collect information such as IP addresses, browser or device identifiers, pages viewed, clicks, and other Website interactions. Information can be associated with an advertising platform account or device. Collection and use are subject to applicable notice, consent, and opt-out requirements. We do not upload customer contact lists for third parties or affiliated brands to use for their own marketing.
We do not sell or rent customer lists or provide them to other companies for their own marketing. We do not sell customer information for money. Certain advertising disclosures described here may nevertheless be a "sale," "sharing," or "targeted advertising" under state privacy laws. The categories involved can include online identifiers, device and internet activity, general location, and related interaction data or inferences. The recipient categories are advertising platforms, advertising networks, and analytics partners. Payment credentials, financing application content, sensitive information, and the text-enrollment information described in Section 5 are not used for these advertising disclosures.
7 Advertising and cookie choices
You can manage or delete cookies through your browser settings and restrict certain advertising identifiers through your device settings. Opting out limits covered uses; it does not mean you will stop seeing all advertising. Certain information may still be processed to provide requested services, maintain security, or comply with law.
Where applicable law gives you a right to opt out through a recognized browser-based signal, such as Global Privacy Control, that right applies in addition to the request methods described above. These signals differ from legacy "Do Not Track" signals. We do not treat legacy Do Not Track signals as a standalone opt-out request.
Blocking cookies may affect some Website features. Browser settings do not necessarily prevent every type of information disclosure, so you may also contact us to exercise applicable privacy rights. Choices may need to be applied separately on each browser or device. Where prior consent is required for a technology, we obtain it before activating that technology.

8 Email text messages and other communications
Email. You can unsubscribe from promotional emails by using the unsubscribe link in a message or contacting us. We honor requests within the period required by law. We may still send legitimate nonmarketing communications, such as requested receipts, service updates, safety information, or responses to an inquiry, where permitted. We do not disguise promotional content as a transactional communication.
Text messages. Marketing SMS and MMS messages are sent only with the consent required for that program. Consent is not a condition of purchase. Providing a phone number for an appointment, visiting our site, or agreeing to general website terms does not itself enroll you in marketing texts. Enrollment, frequency, charges, and other program details are described in the Text Messaging Terms within our Terms and Conditions and in the enrollment disclosure.
Reply STOP to automatically unsubscribe from our text messaging program, or use another reasonable method to tell us to stop, including the contact methods in Section 16. Reply HELP for assistance. We process revocation promptly and within applicable legal deadlines. We may send a single nonpromotional confirmation where permitted. We do not treat an opt-out as permission to move you to another texting number or program. Email and SMS preferences are separate unless you ask us to stop both; broader requests are applied to their stated scope as required by law.
Other channels. You can request that we stop marketing calls or direct mail using Section 16. We honor applicable do-not-call, consent, and suppression requirements. Any recording or monitoring that requires notice or consent is subject to those requirements at the relevant interaction.
9 Privacy rights and requests
Depending on your residence, our activities, and the law that applies to the information, you may have rights to confirm processing; access or know the categories and specific information held about you; obtain a portable copy; correct inaccuracies; delete information; and obtain information about recipients or categories of third parties where the law provides that right. You may also have rights to opt out of sale, sharing, targeted advertising, or certain profiling, to limit certain uses of sensitive information, or to withdraw consent.
We do not use your information for automated decisions producing legal or similarly significant effects through our website advertising activities.

Describe the request and provide enough information to locate the relevant records. We do not require you to create an account to exercise rights. For access, correction, or deletion, we may request information reasonably needed to verify your identity and protect against unauthorized disclosure. We do not require identity verification for advertising opt-outs beyond what is lawfully needed to apply the request to the relevant information.
An authorized agent may submit a request where permitted by law. We may require proof of authorization and any direct verification legally permitted for the type of request. Information supplied to verify a request is used only for verification, request administration, security, and legally permitted recordkeeping.
We respond within the deadlines that apply to your request and notify you of any permitted extension or denial as required. Rights are subject to legal exceptions, including retaining information needed for transactions, safety, recalls, warranties, legal obligations, fraud prevention, or claims. If an appeal is available, send it through the same contact methods with "Privacy Appeal" in the subject or request. We will explain the outcome and any further complaint rights, including contacting your state attorney general, as required by law. We do not unlawfully discriminate or retaliate against you for exercising privacy rights.
California residents. Where the California Consumer Privacy Act applies, your rights include knowing, deleting, correcting, and opting out of sale or sharing, and limiting covered uses of sensitive personal information. We do not knowingly sell or share personal information of consumers under 16. You may also request information about disclosures for third parties' own direct marketing under California's Shine the Light law where applicable. These rights supplement, and do not reduce, the rights described above.
10 Retention
We retain information only as long as reasonably necessary and proportionate for the purposes described in this Policy, subject to applicable legal requirements. Contact and customer records are retained for the customer relationship and necessary follow-up; vehicle, transaction, and warranty records for service, coverage, tax, safety, recall, and legal obligations; and communications for support, dispute resolution, and required recordkeeping.
Online activity, advertising information, and related inferences are retained for the useful life of the relevant measurement or advertising purpose, subject to vendor settings and your choices. Consent, withdrawal, privacy-request, and suppression records may be retained longer when necessary to demonstrate compliance and prevent further unwanted communications. Security logs are retained based on security needs and investigation requirements. We consider sensitivity, necessity, contractual duties, applicable limitation periods, and legal holds; we do not retain information indefinitely simply because storage is available.
11 Security
We use reasonable administrative, technical, and physical safeguards appropriate to the information and our operations. No website, transmission, or storage system is completely secure. We cannot guarantee absolute security. This statement does not limit security duties or remedies that cannot lawfully be limited. 12 Children
Our online Services are intended for a general audience and are not directed to children under 13. 13 Processing locations and third party services
Our Services are intended primarily for customers in the United States. We and our providers may process information in the United States or other countries where we operate. Laws may differ between countries. Where transfer safeguards are legally required, we use appropriate safeguards. Accessing the website does not waive your applicable rights or substitute for a required transfer mechanism.
External financing applications, map tools, review platforms, embedded media, and social media features may collect information under their own policies. Review the notices at those services. We remain responsible for our own collection and disclosures and do not use a third-party link to disclaim obligations imposed on us by law.
14 Changes to this policy
We may update this Policy to reflect changes in our practices or applicable requirements. The effective date identifies the current version. We provide additional notice and obtain consent when legally required for a material change. A revised policy does not retroactively authorize uses that were prohibited or require consent that has not been obtained.
15 Relationship to other terms
Our Terms and Conditions govern website use and include text messaging program terms. This Policy describes information practices; it does not require you to surrender nonwaivable privacy rights, consent to all marketing, or accept all tracking merely by reading it or using the website.
